Tech giant Shopify recently won a major legal victory against the Canada Revenue Agency (CRA) regarding the data privacy of merchants using its platform. This court decision could have significant implications for how user data is protected and the role of technology platforms in defending their users’ privacy.
Shopify and the CRA: A Major Legal Battle
The conflict between Shopify and the CRA began when the agency attempted to obtain more than six years of records on merchants using Shopify’s software. This data included personal information such as the names, addresses, phone numbers, and banking information of Shopify account owners. The CRA’s objective was to ensure that Canadian merchants complied with the Income Tax Act and the Excise Tax Act.

The Federal Court’s Request and Its Implications
A federal court order, made public Thursday, shows that Justice Guy Regimbald sided with Shopify in rejecting the CRA’s request. The judge ruled that the agency had not described an identifiable group of individuals whose data it sought. In his words, the court cannot grant a request for disclosure of information from unspecified parties that is “unintelligible, incoherent, or otherwise incomprehensible.”
International Implications
In addition to Canada, the CRA had received a similar request from the Australian Taxation Office, which sought to ensure that merchants were complying with Australian tax laws. However, Shopify contested that the multilateral tax treaty used to justify the request could not apply to unnamed individuals.
In both cases, Shopify argued that the group of merchants subject to the information requests was “overly broad and inconsistently defined.”

A decision celebrated by Shopify
Shopify CEO Tobi Lutke expressed his satisfaction with the outcome of the case. He shared on X, emphasizing that the CRA’s behavior was a “blatant abuse.” This victory strengthens Shopify’s position as a defender of its users’ privacy, while highlighting the ongoing tensions between tech giants and tax authorities. Financial Consequences for the CRA
As a result of this decision, Justice Regimbald ordered that the CRA cover Shopify’s legal costs, amounting to $45,000 per case, for a total of $90,000. This financial penalty underscores the seriousness of the situation for the government agency and could serve as a warning about how it approaches data collection issues in the future.
